ThermaPure Explains Defeat by Temp-Air

A U.S. district court ruled that Temp-Air did not infringe on a pair of Thermapure patents.

BURNSVILLE, Minn. and VENTURA, Calif. — After more than one year of litigation, Temp-Air has won judgment in its favor in Thermapure’s infringement suit over U.S. Patent Nos. 6,327,812 (the “’812 patent”) and 7,690,148 (the “’148 patent”). Click here to view a copy of the consent judgment.

Judgment Against ThermaPure

The past week has shown a flurry of activity with regard to ThermaPure litigation. On November 23, 2011, a Consent Judgment was entered between ThermaPure and Temp-Air Inc. in Minnesota. The Judgment was the result of a settlement agreement but included a number of important statements of fact, which became findings and conclusions of the court:

ThermaPure Litigation Report #1

On January 14, 2011, ThermaPure Inc. filed a lawsuit in California against Coast to Coast Water Damage Restoration, Inc. and the four other contractors listed on the Water Out web site as California service providers.

Claiming an infringement on its United States patent number 6,327,812 (commonly called "the 812 patent"), on June 22, 2011, Thermapure, Inc. filed suit against Yuma, Arizona based SCR-Sun Country Restoration, Inc.  The federal court case is one in a series of actions initiated by Thermapure concerning its method of killing organisms and removal of toxins in enclosures.

ThermaPure Litigation Report #3

In yet another in a series of actions initiated by Thermapure, Inc., a Ventura, California-based company, Thermapure filed suit against Pinnacle Emergency Management, Inc., in federal court on Friday, June 24, 2011, claiming Pinnacle infringed on Thermapure’s U.S.
